Lawsuit For Specific Performance of Real Estate Sale
Our law firm litigates all types of real estate disputes. Here, attorney Brad A. Brelinski was retained by a couple who was in the process of buying their dream home in Jackson County. Despite having a signed and enforceable purchase agreement, the seller was hesitating to follow through on the transaction, and ultimately refused to close the sale. The very next day, our firm filed a lawsuit in the Jackson County Circuit Court, seeking to force the seller to close the sale (specific performance), and for monetary damages caused by the seller's breach of contract. In short order, we obtained a court order compelling the seller to close, and after the closing was completed, we returned to court for a damages hearing/trial, where the judge awarded our clients nearly their entire claim for financial damages in the five-figures, including costs and attorney fees, all of which was quickly collected from the defendant seller.
